The Schroeder Institute® of the Truth Initiative Foundation dba Truth Initiative (“Truth Initiative”) provides the UbiQUITxt smoking cessation text messaging program (“UbiQUITxt” or “program”) under the following conditions, which may be amended from time to time. Your use of UbiQUITxt constitutes your agreement to these terms. Your use of the program is also subject to the terms of the UbiQUITxt Privacy Policy. Medical Disclaimer The UbiQUITxt smoking cessation text messaging program is provided for the general purpose of furthering Truth Initiative’s mission of achieving a culture where all youth and young adults reject tobacco. It does not constitute medical advice. It is not to be used to make diagnoses, prescribe medicine or provide treatment, and should not be relied upon as a substitute for consultations with qualified health professionals who are familiar with your individual medical needs. This program is provided as an informational and self-help service to help you quit smoking. Please contact your health care provider with any concerns about your physical or mental health or about whether this program is or is not working for you. UbiQUITxt does not promise or guarantee any outcome, including that you will successfully quit smoking.
Delivery of Services Disclaimer Your use of the program from a mobile device is subject to any agreements you have with your network service provider and any fees they may charge. These fees may include but are not limited to fees for text messaging, data use or internet access. Any fees to send or receive UbiQUITxt text messages are your sole responsibility.
Text message delivery from or to a mobile device may fail due to circumstances or conditions beyond Truth Initiative’s control. Truth Initiative is not responsible or liable for service interruptions or problems including but not limited to mobile network services. Services provided may be interrupted or contain errors, and platform defects may not be corrected. Text message communications from UbiQUITxt are not encrypted and therefore messages can be read by external parties before reaching a subscribed device. Although Truth Initiative’s use of this information is governed by our Privacy Policy, it is possible for these communications to be intercepted or accessed without your authorization.
Consent to Use UbiQUITxt You will not receive any messages until you have opted in to use the UbiQUITxt program by texting OK in response to the initial enrollment message.You can cancel the program at any time by texting STOP as a response to any message. Text HELP in response to any message for additional information.
Costs and Availability Message and data rates may apply. If you do not have an unlimited text message plan, you should check with your cell phone carrier to determine what charges you may incur from using ubiQUITxt. The UbiQUITxt program is available on most cell phone carriers. The frequency of messages that you receive will depend on your participation in the program. The program is designed for users to receive a minimum of 1 message per day for most of the program. If you set a quit date, you will receive more frequent messages around your quit date.
Intellectual Property The UbiQUITxt smoking cessation text messaging program, including but not limited to the content of all text messages sent pursuant to the program and the technology itself, is owned by Truth Initiative and may not be used for any purpose without written consent of Truth Initiative. UbiQUITxt is a trademark of the Truth Initiative Foundation dba Truth Initiative and may not be used for any purpose without written consent of Truth Initiative.
User-Provided Content You, not Truth Initiative, are responsible for any information or content you provide through the program. Any personally identifiable information you provide to Truth Initiative through the UbiQUITxt program is protected by and subject to our Privacy Policy. If you choose to provide personal information, we may use that information to customize and improve your text message experience. If you sign up to receive text messages from us, we will use your information only to send you messages you have opted to receive.
Limitation of Liability You understand and agree that you will hold harmless Truth Initiative and its officers, directors, employees, and agents from any and all claims arising out of or related to your use of, or your inability to use, the UbiQUITxt smoking cessation text messaging program or the information contained therein. You further understand and agree that Truth Initiative and its officers, directors, employees, and agents will have no liability to you or anyone for any direct, indirect, special, compensatory, punitive or other damages or monetary claims of any kind whatsoever.
Program Modifications Truth Initiative reserves the right to change or terminate any aspect of the program, including individual user accounts for any reason or no reason at any time. Truth Initiative also reserves the right to impose limits on certain features of the program without notice or penalty.
Modifications to Terms of Use We reserve the right to change any aspect of these Terms of Use at our discretion. All changes will be posted to this website and will take effect when they are posted.
